INFORMATION ABOUT ONLINE ORDERS  *****PLEASE READ BEFORE ORDERING!***** THERE ARE NO RETURNS PERMITTED ON AMMUNITION AMMUNITION PURCHASES 

 You must be 18 or older to purchase rifle or shotgun ammunition and 21 or older to purchase handgun ammunition. All ammunition will be shipped ground with adult signature required. Always make sure to use the correct ammunition for your specific firearms as we cannot accept returns on ammunition - there are no exceptions to this...sorry. Check your local laws for any other regulations. 

 RETURNS FIREARMS & SERIALIZED PARTS - a special order may only be canceled or changed to a different item before shipping from the warehouse facility. Any change to the order after shipment from the distribution warehouse, but prior to taking delivery of the item will incur a 15% restocking fee and you will be assessed the shipping charge to return it to our warehouse if we do not normally stock the item. This is solely at Hesseling & Sons discretion. There are absolutely no returns for refund or credit on serialized parts and firearms once you have completed the ATF paperwork and taken delivery of the item(s). We will assist you in repairs/malfunctions if there is an issue with the item and even help return it to the manufacturer if that is necessary.

 For NON-serialized items: If you are not satisfied with your purchase, please contact us for a Return Merchandise Authorization (RMA) request within 10 business days of the receipt of the product (online purchases only). If the item is returned unopened in the original box, we will exchange it, offer you store credit, or offer you a refund based on your original method of payment. The product must be returned within 10 business days of the issuance of the RMA. All products must be packed in the original packaging, including any accessories, manuals, documentation, and registration that shipped with the product. A 25% restocking fee will be assessed to all online orders that are cancelled that are requested as an item(s) to be sent to our storefront from our warehouse (non-stock items).  

PLEASE NOTE: As soon as you place your order, our warehouse is notified to pick your item for shipment and send it to us. We cannot stop this shipment. Sorry no exceptions as we are stuck with the item that you ordered. A 25% open box/package will be assessed on any sealed product that is opened or removed from its original packaging. Any parts that have been installed, or attempted to install, cannot be returned.  Please note that we do not permit the return of the following products: (1) Special orders and products that are custom configured to your specifications. (2) Products sold "as is" or "used" or that have been installed or used after receipt. (3) NFA items that require ATF Transfer after the start of paperwork. (4) Ammunition, illumination devices, electronic sights, optics, garments, night vision equipment, or holsters. 

 Note: We recommend that you use a carrier that offers shipment tracking for all returns, and insure your package for safe return so that you are protected if the shipment is lost or damaged in transit. If you chose not to use a carrier that offers tracking and/or insure the shipment, then you will be responsible for any loss or damage to the product during shipping. The United States Postal Service (USPS) offers limited tracking capabilities and that there is a 30-calendar-day waiting period before USPS will initiate a trace. The customer is responsible for shipping charges both ways on returns, as well as for shipping charges on shipments that are refused unless if a manufacturer's warranty covers the cost of return to the factory. 

 Custom Orders:  We are a full service custom shop offering Cerakote, GlitterGunz Coating, Engraving and Laser work.   If you place an order for custom services, that sale is final.  If you change your mind on how you want your project, there will be a change fee.  That fee is determined by what has to be changed.  Please ensure you are ordering exactly what you want BEFORE you finalize your order.  There can be no exceptions to this policy as custom work is very specific to you and there is a cost involved to us for any changes you request.  That cost will be passed along to you.  

 Raffles:  There are NO RETURN for Raffle Tickets purchased online. There are no exceptions to this.    

 Online Purchase of Firearms that Fail to Transfer to Purchaser 

 It is the buyer's responsibility to know the firearm laws of the local and state government in which you reside. 

If a firearm is restricted in your area then DO NOT PURCHASE IT!  

Also, only purchase a firearm if you are not restricted by law from owning, buying, or possessing a firearm. 

Please refer to the Bureau of Alcohol, Tobacco, Firearms, and Explosives (BATFE) website to learn what restricts an individual.  

 If you purchase a firearm and cannot take possession of the firearm through the legal transfer process, then there will be a mandatory restocking fee of 25% based on the total amount of the purchase. Additionally, any shipping charges will be withheld from your refund - this includes freight charges to and from the receiving gun store (FFL Dealer).  

 If we cannot verify your receiving FFL Dealer's license within 10 calendar days of your order to authorize shipment, then we will cancel your order and the above restocking fee will apply without exception. We will attempt to reach your FFL Dealer by phone and by email (if available) a maximum of 2 times via each method. If we do not receive their license after these 4 attempts have been made then we will require you to make contact with the FFL Dealer to assist in providing us with their license. You always have the option to change FFL Dealers if they refuse to accept the transfer or they fail to provide their license information to us. However, there is a 10 day allotment for this to be accomplished.  

 Serialized items that are incorrectly ordered or no longer wanted by the customer will incur a 25% restocking fee (this is based on the overall total of the item), plus all shipping charges to and from the receiving FFL dealer. If you have any questions about an item then please contact us with your questions prior to ordering. We are more than happy to answer all your questions to help you purchase the correct item.  

 CANCELLING A PURCHASE OF A FIREARM PRIOR TO SHIPMENT TO YOUR LOCAL FFL DEALER: If you decide to cancel your order of a firearm prior to shipment from our store then you will receive a refund, less a 15% restocking fee based on the total amount of the purchase, without exception. Customized firearms cannot be cancelled. 

 TRACKING INFORMATION: We utilize UPS, FedEx, and USPS for shipping carriers. You will receive an automated tracking number from the shipping carrier, or an email from us - one of the two. Please check you email including your spam folder for this information. If you do not see a tracking email after your item has shipped then please email us at info@hesselingandsons.com, or call our store at (567) 712-6836. DO NOT utilize social media message apps to attempt to reach us because we receive hundreds of messages per week and we do not want it to get put further down in the queue than necessary. Wanting to cancel your order because you cannot find your tracking information, or believing you did not receive tracking information without FIRST emailing or calling us will result in a 25% restocking fee, plus shipping costs.  

 ADDITIONAL SHIPPING & HANDLING POLICIES - 

We do not export. - We will ship to Alaska and Hawaii but the standard shipping charge our web store charges is NOT accurate. We will contact you after we receive your order with the correct shipping charge. We will only charge actual freight fees. If you decide you do not want the product(s), then we will issue a full refund if cancelled within 24 hours of our notification of the actual freight charges. Please contact us for further questions. HazMat Shipping Policies Hazmat Packages:  We can ship up to 48 lbs of different powder and primers under one hazmat fee to save you money. FedEx charge $19.95 per package on Hazardous Materials. Powder and Primers are Hazardous. Standard Shipping charges also apply. FedEx requires a signature on all hazardous material packages and will not allow the packages to be redirected to an alternate address. Please make sure someone will be available to sign for your package when delivered. If no one is available to sign for the package when delivered and the package is returned to us, customer is responsible for all charges related to the return.   

 WEBSITE DISCLAIMER Other items available for sale not listed on this website include discontinued parts or parts for firearms no longer produced. Please contact us if you have any questions regarding parts for firearms no longer produced (such as Vietnam era upper receiver units, obsolete fire control parts, etc.). All items on this website are subject to change without notice. This includes item availability, one-of-a-kind items, and pricing. Stock photos are supplied and uploaded by manufacturers and distributors. We are not able to monitor the 10's of thousands of items for accuracy. Check with us if you have questions about the accuracy of the product you are considering for purchase.  

 USED FIREARMS The seller provides all descriptions for used items. All descriptions for used items are honest and based on actual items being offered for sale. Items being sold in this manner will be marked as such. All sales on used items are final. Photos will be provided when available. All machine guns are considered used unless otherwise noted. 

 GENERAL FIREARM SALES All firearms, magazines, receivers and restricted law enforcement items are sold and shipped in accordance with all existing federal, state and local laws and regulations. Firearms will ONLY be shipped to licensed FFL dealers. Many of the firearms, magazines, and parts for sale on this website may be restricted or prohibited in your area. Please check your local and state regulations before ordering. All new firearms are shipped in the original manufacturer's box, with magazine(s), accessories and applicable warranty. Firearms requiring warranty work must be returned to the factory within their specified warranty time period for repair. Accessories and special order items not normally sold by our store will not be covered under warranty even if these products are part of an integrated firearms package, unless we have guaranteed the entire package in writing. Please contact the original manufacturer for warranty information on all accessories and special order items. 

 CUSTOMER SERVICE If you encounter any problems with your order or the checkout process, or if you have any questions about the status of your order, simply contact our customer service staff through our Contact Us page. 

 CONSUMER DATA PRIVACY We respect your privacy and are committed to protecting it. The Credit Card Billing Information, Shipping Information, and Contact Information in our checkout process are required in order to process your order and deliver the product to you. We store some information for accounting reasons. Your information will not be shown to third parties not involved in the transaction, nor used to send you any unrequested information. The entire Checkout process is handled through a secure SSL-encrypted connection. The Credit Card Billing Information is sent directly to our payment provider who processes your credit card transaction. The credit card information is neither recorded nor stored by us, and it can only be accessed by our payment provider. Each transaction has a very high level of security. Your credit card details are sent directly to the payment provider over a secure SSL-encrypted connection. They are not processed on our servers at any stage of the transaction, nor are they stored on our server. SECURE TRANSMISSION All information collected during the checkout process is transmitted via industry standard Secure Sockets Layer (SSL) featuring 128-bit encryption. A Secure Sockets Layer (SSL) Certificate creates an encrypted link between a Web site and a visitor's Web browser. This link ensures that all data passed between the Web site and the browser remains private and secure. 

 ORDER FULFILLMENT All orders are shipped promptly from our warehouse or in-store inventory within 3 - 10 business days using UPS, FedEx, or USPS. Tracking numbers are available for items shipped via UPS and FedEx. 

 ONLINE PRICE & DESCRIPTION ERRORS Our online inventory changes every day. Occasionally an item may appear on the site by mistake or the item's description may contain a typographical error. We do not guarantee that titles, descriptions, pictures or prices on our site are error-free. We reserve the right to refuse any order including but not limited to orders for items with errors in the description or price. In the event that we cancel an order we will not charge the customer's credit card or we will refund the money. If an item's description contains an error such as incorrect price and a customer makes the order, we will not process the order without first contacting the customer. If the order is mistakenly shipped, we may advise the customer to return the item in an unopened condition and we will refund the customer. By placing an order, the customer agrees that seller will be the final arbiter of discrepancies in the online catalog. 

 TRANSFERS 

 Standard Transfers: Our transfer fee for receiving/background check is $35.00 (plus tax) for standard non-NFA transfers. If you are dissatisfied with your online purchase, then it is your responsibility to pay for the return shipping (varies by item) and the return transfer fee ($35.00). We do not inspect the quality, or warrant the condition, of any item not purchased from Hesseling & Sons. Your guarantee on the item is only backed by the seller and the manufacturer (if applicable). 

 Blind Transfers: 

Q:What is a blind transfer? A: Any serialized item purchased from another source that is transferred to us without any notification made by the buyer of the item(s). PLEASE NOTE it is not the seller's responsibility to contact the receiving FFL Dealer of the impending transfer! We charge a non-negotiable $15 fuel/time surcharge to the $35.00 transfer fee to release an item for which we are not informed of prior to receiving. Please call ahead, email, or stop by and notify us of any transfer coming our way.  

 NFA Transfers: (National Firearms Act Items)Effective 1/1/2020: All NFA transfers will be charged a fee of $100 for any Machine Gun, Suppressor/Silencer, AOW (Any Other Weapon), Destructive Device, and Short Barreled Rifle. Storage Fee: We charge a daily storage fee of $3.00 per item for transfers that remain in our store for more than 14 days once we contact you that it is ready for pick up. If the item(s) remain in our store for more than 30 days will receive an abandoned firearm notice from us. If the item is not picked up within 60 days of us first contacting you then the item will become the property of Hesseling & Sons.      

AMMUNITION sales are FINAL - Returns cannot be accepted for ammunition.   

 All suppressors are shipped for a flat fee of $35.00. Your dealer will send us the proper paperwork for this first transfer, we prepare and fax the Form 3 transfer to BATF immediately, and then once the transfer clears BATF we ship the gun to your dealer. You're in-state dealer then prepares Form 4 paperwork, which you will sign and also have signed by the Chief Law Enforcement Officer in your locale (Sheriff, Chief of Police, State Police Chief, etc... only need for one to sign). You return the completed Form 4's to the in-state dealer, along with (2) passport size photos, (2) fingerprint cards, (1) citizenship authorization, and a transfer tax check made payable to Bureau of Alcohol, Tobacco and Firearms for the onetime per item transfer tax. A $200.00 transfer tax applies to Short Barrel Shotguns, Short Barrel Rifles, Machine Guns and Suppressors; a $5.00 transfer tax applies to items classified as Any Other Weapons - "AOW". This paperwork is mailed to BATF and when this transfer clears you go pick up your gun. We email/contact our customers each step of the way, so you will know when your gun arrives in state and the next transfer, from your dealer to you, can begin.

• I am not an unlawful user or addicted to any controlled substance.
• By selling or delivering ammunition to me, Hesseling & Sons Firearms & Gunsmithing is not violating any state or local law or ordinance.
• I have never been and I am not expected to be convicted in any court of a misdemeanor crime of domestic violence.
• I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for over one year.
• I am not a fugitive from justice.
• I am currently not subject to a restraining order of any kind.
• I have not been adjudicated as a mental defective and I have not been committed to any mental institution.
• I am not an illegal or unlawful alien.
• I have never been and I am not expected to be discharged from the Armed Forces under dishonorable conditions.
• I am not currently less than twenty-one (21) years old.
• I have not renounced my U.S. citizenship.

INDEMNIFICATION AND AGREEMENT TO DEFEND

I fully agree that if any of my representations when making purchases under the Terms of Sale are incorrect or if I fail to comply with these Terms of Sale, then I will indemnify, defend, save harmless, and release .com and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from my purchase from Hesseling & Sons Firearms & Gunsmithing.

I fully agree that by placing my order, I release Hesseling & Sons Firearms & Gunsmithing from any and all liability arising from or related to the products I purchased from Hesseling & Sons Firearms & Gunsmithing, including (but not limited to) my or anyone else use of the product, my or anyone else’s storage of the product, and my or anyone else’s handling or transportation of the product, and I agree to indemnify, defend, save harmless, and release Hesseling & Sons Firearms & Gunsmithing and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from the products I purchased from Hesseling & Sons Firearms & Gunsmithing.

CLASS ACTION WAIVER

You expressly agree that any dispute resolution proceedings, including but not limited to, litigation, arbitration, and mediation, will be conducted only on an individual basis and not in a class, consolidated, or representative action. By making this express agreement, you acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of any right to bring federal, state, or local claims as any part of, or on behalf of, any class or any other individuals, before a court or other tribunal.
